Although DUI laws vary from state to state, it is illegal to operate any type of motor vehicle while under the influence. Some of the telltale signs of a drunk driver include erratic and inattentive driving. While hundreds of thousands of motorists are accused of drunk driving across the US each year, the only evidence that will stand up in courtrooms are sobriety tests. This evidence can consist of field sobriety tests and breathalyser results. Usually, officers will administer field tests when they feel that a motorist is under the influence of drugs or alcohol. Some of the indicators that they look for are; slurred speech, the strong odor of alcohol, delayed responses and dilated pupils. Failing one or more field sobriety test can give a police office enough justifiable cause to place you under arrest.Alternatively, you can elect to take a breathalyser test if you feel as though you do not want to take field sobriety tests. It is not uncommon to confuse a fatigued driver for someone that is under the influence. Some police jurisdictions can force suspects to take blood tests to determine their blood alcohol levels. This evidence is usually viewed as being much more powerful in the courtroom because it is nearly impossible to masks the results of a blood alcohol level test. It is important to know what your rights are in the event that you are accused of driving while intoxicated so that you will know how to proceed. Make sure that you are able to provide information about your whereabouts prior to being pulled over so that you are able to establish an alibi. Having eye witness testimony that certifies that you were not drinking will help immensely if your case ever goes before a judge.
If you have previously been convicted of drunk driving you may be considered to be a repeat offender. Habitual drunk drivers face stiff penalties that include the revocation of your drivers license, probation and jail time. Your car may also be impounded and sold at a state run auction if you have an accident that causes considerable property damage while you are under the influence. You may also be required to pay additional restitution if the proceeds gained by the sale of your car do not satisfy you outstanding fines. For these reasons you should always know what your limitations are, and if in doubt call a cab or ask a friend to take you home.
