California Assemblyman Martin Garrick Arrested For DUI
Officials from the Sacramento Police Department have reported that Republican Assemblyman Martin Garrick was pulled over on suspicion of drunk driving and subsequently arrested for having a blood alcohol level that was almost twice the legal limit in the state. According to court documents, Garrick was driving 20 miles per hours over the posted speed limit and failed to yield at two stop signs. When police on bicycles attempted to pull Garrick over, he allegedly failed to obey their commands. An attorney for Garrick says that his client was distracted and simply didn't hear the officers' repeated requests. After a short period of time, Assemblyman Garrick did stop the state issued vehicle that he was operating at the time of police contact and was asked to perform several standard field sobriety tests. Police say that Garrick failed his field sobriety tests, so he was transported to the CHP Capitol Protection Office where his blood alcohol levels were tested.
Police found that Garrick's blood alcohol level was well over the state limit of .08, and he was arrested for DUI. After posting bail, Garrick made a public statement to his constituents, profusely apologizing for his arrest and promising never to drink and drive again. Garrick's arraignment is scheduled for the 15th of August, where his lawyers will likely try to get the blood alcohol evidence thrown out of court. Though Garrick will probably be fined, he also risks jail time as well. Before the accident, Garrick was considering other positions in office, but it is now unlikely that he would be able to get elected.

Two Alleged Thieves Cleared Of Hate Crime Charges
After an unnamed transgender woman was allegedly assaulted and robbed in San Franciso, the prosecutor's office considered classifying the attack as a hate crime. It is not uncommon for members of the LGBT community to face physical acts of violence in the US, but many of the cases face hurdles when the intent of the perpetrators is examined.Maurice Perry and Lionel Jackson have been charged with assault and theft, but their lawyers claim that the victim was assaulted during the course of a robbery. A witness made a statement confirming that the perpetrators acted out of hate. Allegedly, Alexandra Byerly, heard Jackson and Perry remarking on the gender of their victim as the fled on foot. Despite the evidence against them, San Francisco Superior Court Judge Bruce Chan decided to drop the hate crime charges.
Although the victim was not seriously injured, LBGT groups are alarmed at the judge's decision. In few cases involving hate crimes are prosecutors able to prove that the perpetrators acted with the intention of inflicting harm on a member of the gay, lesbian or transgender community during the crime. Usually, the decision is made beforehand and police are able to gather evidence supporting these facts after the crime has occurred. Byerly has no association with the victim and was able to hear that both Perry and Jackson 'hate' men that appear to be women. Judge Chan declined to explain why he dropped the hate crime charges, but the accused robbers will still have to stand trial on a number of other offenses.
